Teckwood Limited (“Teckwood”) warrants to the original purchaser that Teckwood product shall be free from material defects in workmanship and materials and shall not split, splinter, rot or suffer structural damage from termites or fungal decay. The term of this warranty is as the individual warranties below and is subject to paragraph 2.
Teckwood DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE

TECKWOOD SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES (INCLUDING FOR PERSONAL INJURY) WHETHER BASED ON NEGLIGENCE, BREACH OF WARRANTY, STRICT LIABILITY OR ANY OTHER THEORY. IN NO EVENT SHALL TECKWOOD’S LIABILITY UNDER THIS WARRANTY, WHETHER TO THE ORIGNAL PURCHASER OF A DEFECTIVE PRODUCT OR ANY THIRD PARTY CLAIMING ON BEHALF OF SUCH PRUCHASER, EXCEED THE PURCHASE PRICE RECEIVED BY TECKWOOD FOR SUCH DEFECTIVE PRODUCT OR THE COST OF REPLACING SUCH DEFECTIVE PRODUCT.
Every claim under this warranty shall be deemed waived unless:

Teckwood installation guides are designed as a quick and simple guide. They may not cover every installation scenario envisaged. Since each installation is unique, the installation method used and/or the actual installation and its actual performance are the sole responsibility of the installer.
Teckwood recommends that all designs be reviewed by a licensed architect, or engineer before installation. Please ensure your plan and/or design meets building regulations and permission before you begin installation.
If you are unsure of the best practices, please use suitably qualified personnel to prevent injuries or accidents.

If any of the provisions in this warranty are determined to be invalid, illegal or unenforceable, the validity, legality and enforceability the rest of the provisions of this warranty shall be unaffected.
This warranty, together with the provision of Teckwood’s quotation and invoice with respect to the product(s) in question, supersede and replace all prior negotiations and/or agreements made between Teckwood and the warranty claimant, whether oral or written, and contain the entire understanding between such parties with respect to the subject matter hereof. No waiver or modification of these terms shall be binding upon Teckwood unless made in writing and signed by a duly authorised Director of Teckwood. Additional or different terms submitted by anyone other than Teckwood are specifically rejected and shall be deemed to be of no effect.
This warranty is not transferable or assignable and is provided only to the original purchaser of the product(s) in question.
The Buyer may not return any Goods without first communicating with the Seller.
Neither Buyer nor Seller shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of the Buyer and/or Seller. Such causes include, but are not limited to: power failure, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the party in question.
Any waiver by the Seller, for any kind or type of breach by the Buyer of these Terms and Conditions shall not be considered as a waiver or affirmation or acquiescent of any subsequent breach of the same or any other Term.
In the event that one or more of these Terms and Conditions is found to be unlawful, invalid or otherwise unenforceable, that or those provisions shall be deemed severed from the remainder of these Terms and Conditions of which shall remain valid, binding and enforceable.
This Contract is not enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These Terms constitutes the entire agreement between the Seller and the Buyer and supersedes other statements, representation, promises, conditions, understandings or other agreements, whether oral or written.
The Seller may vary these Terms in relation to future sales from time to time by publishing new Terms on the Website or by otherwise notifying the Buyer of the new Terms.
This Warranty is governed by and interpreted in accordance with the laws of England and Wales.
